What should you tell your client who asks whether they need to talk to police? What if your client is accused of something and they do not expressly deny it? What if they are unconscious in the hospital after a car accident, and wake up to police questioning? At what point does a roadside detention become custodial for purposes of Miranda? What constitutes interrogation under Miranda? When can you challenge alleged spontaneous statements? Is it true that your client does not have a right to an attorney when police ask them what chemical test they will take? Lara will discuss these issues and more in a cutting-edge talk about Miranda warnings in DUI cases.

PRESENTER: 

Lara Gressley grew up in Northern California and received her undergraduate degree at the University of California, Santa Cruz. She attended law school at Santa Clara University School of Law. Lara first gained experience defending DUI cases at the Santa Cruz Public Defender's Office. She later worked as a court-appointed trial attorney in Riverside, where she tried several serious cases to verdict. In addition to her trial experience, Lara has become one of the preeminent criminal appellate attorneys in California. She represents petitioners and appellants in criminal writs and appeals in California, U.S. District Court, the Ninth Circuit, and in the U.S. Supreme Court. Lara has also worked on Amicus Curiae briefs in some leading drunk driving appellate cases in California, including People v. VangelderPeople v. Harris, and People v. Arredondo, and in the U.S. Supreme Court DUI case of Mitchell v. Wisconsin. She also handled a successful petition for a writ of habeas corpus in the U.S. District Court in a DUI matter. Lara lectures for attorney organizations on Constitutional Law, criminal motion and trial work, DUI defense, research and writing, and writs and appeals. Lara is a contributing author for Donald Bartell's book, Attacking and Defending Drunk Driving Tests, and she is a past President of CDLA.
